Welcome to Orbit Leads (“Orbit Leads,” “we,” “us”), the operating company behind a family of real estate technology products, including buyer discovery apps, seller marketplaces, agent-matching services, and an agent CRM (collectively, the “Services”). By creating an account or using any Orbit Leads Service, you agree to these Terms & Conditions. If you don’t agree, please don’t use the Services.
The Services
Orbit Leads operates a real estate intelligence platform: one engine that matches consumers — buyers, sellers, and people seeking an agent — to the specialist best suited to their situation and market, and a centralized CRM that lets real estate professionals manage the leads they receive. Orbit Leads is not a real estate broker and is not a party to any transaction between a consumer and a real estate professional or another third party.
Eligibility & account
You must be at least 18 and able to form a binding contract to use the Services. Real estate professionals must hold any license required for their jurisdiction. You’re responsible for the accuracy of your information, keeping your account secure, and all activity under it.
Matching & lead routing
Where a Service matches a consumer to a real estate professional, the match and any routing of a lead are based on information the consumer and professional provide and on data our engine has about specialty, market, and performance. We do not guarantee that any match will result in a transaction, and we are not responsible for the conduct of any professional or consumer we connect.
Subscriptions, territories & fees
Paid features — including territory subscriptions in our agent CRM — are billed through our payment provider on the terms shown at purchase and renew until canceled. Fees are non-refundable except where required by law. Where a referral fee applies to a lead accepted through our Services, the applicable percentage is disclosed and is payable on a closed transaction under a separate referral agreement.
Your data & compliance
Real estate professionals retain ownership of the contacts, leads, and content they add to our CRM, and grant us a license to host and process it to provide the Services. Professionals represent that they have the right to provide that data and are solely responsible for their own compliance with all applicable laws when contacting people, including TCPA, CAN-SPAM, and Do-Not-Call rules.
Acceptable use
Don’t misuse the Services, including by uploading unlawful or infringing data, sending unlawful communications, scraping, reverse-engineering, interfering with the Services, or reselling them without permission. We may suspend or terminate accounts that violate these Terms.
No guarantees; disclaimers
Matches, leads, valuations, listing data, and other content are provided for informational and business use and are not guaranteed as to volume, quality, accuracy, or outcome. The Services are provided “as is” and “as available” without warranties of any kind to the fullest extent permitted by law.
Limitation of liability & indemnification
To the fullest extent permitted by law, Orbit Leads and its affiliates will not be liable for indirect, incidental, or consequential damages, or for the acts or omissions of any consumer, professional, or other third party. You agree to indemnify and hold us harmless from claims arising out of your use of the Services, your data, or your violation of these Terms or applicable law.
Governing law & changes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. We may update these Terms; the updated version will be posted here with a new date, and continued use means you accept the changes.
